When exercising their right to data portability, the data subject has the right to receive a direct transfer of personal data from one controller to another, when technically feasible.
Right to object
The data subject has the right, at any time and on grounds relating to their particular situation, to object to the processing of personal data concerning them (when the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Administrator, or the processing is for the purposes of the legitimate interests of the Administrator or a third party), including profiling. The Administrator shall cease processing the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or for the establishment, exercise, or defense of legal claims.
When personal data is processed for direct marketing purposes, the data subject has the right at any time to object to the processing of personal data concerning them for this type of marketing, which includes profiling insofar as it is related to direct marketing. When the data subject objects to processing for direct marketing purposes, the processing of personal data for these purposes ceases.
At the latest, at the moment of the first contact with the data subject, they are explicitly informed about the existence of the right under the previous paragraphs, which is presented clearly and separately from any other information.
